Abstract

There were many ways by which Awqaf was usurped, but the most popular method in the Mamluk era (Jarkas) was having a substitute document. The existence of such a method was proven by the documents and the records of the time. Such a method entailed several procedures which resulted in a number of documents that prove the substitution’s validity and continuity alongside with a fatwa issued by judges and scholars. The importance of this study is that it deals with and decodes a substitute document that was lost in the Mamluk era; it is a long tattered document, but we have managed to read it, clarify its content, analyze, investigate and publish it hoping that researchers and students in the field of history and documents will benefit from it.
