Abstract

This paper aims to establish the theoretical concept of digital privacy in light of contemporary technological transformations, with a focus on the social and cultural context of Saudi society. It seeks to highlight the status of privacy as an inherent right of the individual, transcending its technical dimensions to become an issue related to human dignity, freedom, and personal security. This is achieved through a foundational induction that combines a legal perspective with social analysis. The paper adopts a descriptive analytical methodology, based on an analysis of theoretical and conceptual discourses on privacy, employing jurisprudential evidence and Quranic texts, along with a critical reading of the manifestations of digital reality and the practices of tracking and monitoring in the contemporary information environment. The analytical approach focused on linking abstract concepts to real-world applications, enabling the paper to build a comprehensive understanding of the phenomenon. The paper reached several important conclusions, most notably that digital privacy is no longer a marginal concept, but rather a central issue that touches the core of individual and social life. The paper also reveals the fragility of digital awareness among individuals, the growing risks related to the exposure of personal data, and the multiplicity of parties controlling it. She emphasized the superiority of Islamic law in establishing and preserving the concept of privacy for centuries, calling for strengthening the legislative framework and raising community awareness of the importance of digital privacy in an environment characterized by accelerating technological challenges.
